About The Right to Information Act

The basic object of the Right to Information Act is to empower the citizens,promote transparency and accountability in the working of the Government,contain corruption, and make our democracy work for the people in real sense.It goes without saying that an informed citizen is better equipped to keep necessary vigil on the instruments of governance and make the government more accountable to the governed.The Act is a big step towards making the citizens informed about the activities of the Government.

Information as per Section 4(1)(b) of RTI Act, 2005

(i) The particulars of its organization, functions and duties.
The information is available under the part of ‘About us’, ‘Jurisdiction’ and ‘Citizen Charter’ of the Web Site.
 
(ii) The powers and duties of its officers and employees.
The powers and duties of the officers of CGST under various Acts, including the CGST ACT, 2017, Central Excise Act, 1944 etc. for the purpose of discharging their duties in various fields of their job are provided as per the relevant sections of the relevant Act. The link of all such Acts is provided in the Website.
 
(iii) The procedure followed in the decision making process, including channels of supervision and accountability.
The information regarding procedure followed in the decision making process is provided under the part ‘Citizen Charter’.
Besides, for executing the day to day functioning of the Commissionerate the operational hierarchy is as under.

(iv) The norms set by it for the discharge of its functions.
The norms set for discharge of its functions are as enumerated in the attached ‘Citizen Charter’.
 
(v) The rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions.
The officers discharge their duties as envisaged and provided under following Acts and Rules made thereunder.
(i) Customs Act, 1962.
(ii) Central Excise Act, 1944.
(iii) Finance Act, 1994,
(iv) CGST Act, 2017
 
Similarly for functions of office work following Acts and Rules are being used.

(vi) A statement of the categories of documents that are held by it or under its control.
The Department is mainly concerned with the implementation of the Central Excise Act, 1944, Finance Act, 1994, Customs Act 1962, and the CGST Act 2017 and the records are maintained as prescribed under these Acts and the Rules framed thereunder.
 
(vii) The particulars of any arrangement that exists for consultations with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof.
For executing the provisions of the Acts enumerated above the Commissionerate functions as per the policy framed by the Ministry at the level of CBIC (Central Board of Indirect Taxes and Customs) and implements accordingly.
 
(viii) A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or minutes of such meetings are accessible for public.
At Present there is no such committee or body at the Commissionerate level. However, there is one Regional Advisory Committee (RAC) at the level of Chief Commissioner, Jaipur Zone, Jaipur. The functions of the Regional Advisory Committee is purely advisory and Committee is intended for resolving procedural difficulties of general nature and to discuss any matter including policy behind individual cases, but exclude individual cases themselves as also judicial and semi-judicial work.
 
(ix) A directory of its officers and employees.
Directory of officers and employees alongwith office address and name and designation of Head of the Office is provided under the head ‘Contact Us’.
 
(x) A monthly remuneration received by each of its officers and employees including the system of compensation as provided in its regulations.
Officewise information in respect of all officers is provided.
 
(xi) The budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made.

(xii) The manner of executions of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes.
The Department has no subsidy programmes and no amount is allocated, therefore, there are no beneficiaries.
 
(xiii) Particulars of recipients of concessions, permits or authorizations granted by it.
The Department does not grant any concessions, permits or authorizations.
 
(xiv) Details in respect of information, available to or held by it, reduced in an electronic form.
All the important information pertaining to the various areas of Guidelines, Queries, Acts, Reports, Notifications, Circulars, What’s New, Right to Information Act, 2005, Citizens Charter, Jurisdiction ,Site Map, Important Link, etc. is available on the Website . This Website also contains a system for online filing of complaints through CPGRAM by the Public.
 
All departmental orders, Trade notices, Public Notices etc . are being uploaded on the departmental Website and also updated time to time.
(xv) The particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use.
The Citizens can obtain information either from the departmental Website or through the office by applying under RTI, which is being provided as per the norms. However, no Library/reading room is being maintained for public use.
 
(xvi) The names, designations and other particulars of the Public Information Officers.

(xvii) Such other information as may be prescribed and thereafter update these publications every year.
